The Court of Varinder Kumar, PCS, (CJ) (JD) Ludhiana issued an order on 03.04.2018 to Guru Nanak Public School (GNPS), Sarabha Nagar, Ludhiana “restraining the school from deleting the name of children from school and stopping their result”.
The order has been sent through email as well as hard copy delivered on 06.04.2018. Despite this the school is not admitting the students. This is a clear cut violation of the court order. Barinder Singh, Jagdeep Singh, Swaroop Singh and others whose children have been studying in the GNPS for several years and have good record have been denied result and promotion to the next class.
The parents had filed the cases regarding exorbitant fees, annual charges, development fees, activities charges as per Punjab Fee Regulatory Act 2016 in Divisional Commissioner, Patiala against Guru Nanak Public School (GNPS), (Primary Wing Model Town Extension, Secondary Wing Sarabha Nagar) Ludhiana vide receipt no. FS 2992 dtd.18.05.2017. As per Punjab Education Act 2016 U/S 11/3 Any complaint received under this Act, shall be scrutinized by the Regulatory Body within a period of fifteen days from the date of its receipt in accordance with the prescribed procedure, and it shall be finally decided within sixty days.
Since the Divisional Commissioner Patiala failed to redress the grievance within 60 days as per the act, the parents filed a complaint to the National Commission for Protection of Child Rights (NCPCR), Delhi. The NCPCR directed to the Divisional Commissioner Patiala vide letter dtd.23.03.2018 to ensure education of the students till the decision is made and report compliance within 7 days. But Divisional Commissioner Patiala did not act. This behavior of the Divisional Commissioner Patiala smells of connivance with the school.
