Chandigarh: A clothing outlet at Ellante mall Chandigarh has been penalized for charging more than the value mentioned on its price tag. The UT Consumer Disputes Redressal Commission has directed Zara, Inditex Trent Retail India Pvt. Ltd o refund the difference of the price of T-shirt i.e. Rs 200 and to pay a lump sum compensation of Rs 5,000 to the complainant.
Nimish Goyal, the complainant purchased two T-shirts having price code for Rs1380 and the payment thereof was made through the debit card. Subsequently, he found that the MRP (Maximum Retail Price) of one of the T-Shirt was Rs 490 but the opposite party charged Rs 690 and as such they charged Rs 200 in excess of the MRP.
Following this, he further requested the clothing outlet staff to refund the excess amount of but they refused to refund the same on the ground that they were unable to contact the management and asked him to come after one week. Thereafter he visited the outlet after a week but still they did not refund the excess amount.
After hearing the counsel for the parties, the forum ruled, ‘Moreover, the very connotation printed on the goods namely ‘MRP’ leaves no manner of doubt that any trader or person in possession of such articles or goods with an intention to sell it to the consumer has no right to charge more than what is printed thereon.
In this view of the matter, the act of the Opposite Party in selling the T-Shirt more than the value mentioned on its price tag is highly unscrupulous, unfair trade practice and as also deficiency in service on its part.’’
