Chandigarh: Punjab and Haryana High Court on Friday issued notice to Punjab government and two universities, namely Punjab Technical University (PTU), Jalandhar and Technical University, Bathinda. The notice has been issued for October 21.
The Punjab Unaided Colleges Association (POCA) and three other engineering colleges have filed a petition challenging the exorbitant charges and fee of various types charged from these collages by the PTU, Jalandhar and Technical University, Bathinda. The colleges which have filed the petitions along with the POCA are Centre for Management Studies, Gurukul Institute of Management, both situated at Banur and Technology and Gurukul Vidiyapeeth Institute of Engineering and Technology, Jalandhar.
The petitioners have alleged that both the universities are violating directions issued by the Punjab Technical Education Department to them in the matter of prescribing the amount of fee and other charges (other than tuition fee) to be collected from students. While this is envisaged under the notification issued by the Technical Education Department March 1, 2011 that such charges and fee must not be exorbitant, so that colleges do not indulge into profiteering, the PTU, Jalandhar, notification May 19, 2011 has prescribed some amounts to be collected by the concerned colleges from their students, under various heads such as continuation fee, youth welfare fee; cultural and allied activities fee, universities sports facilities development fee, university sports fee, magazines fee, university registration fee and (viii) university eligibility/enrolment fee, which is to be collected by concerned colleges from the students. However, the university has superimposed a condition that such charges and fee shall be reimbursed by the concerned colleges to the university.
The counsel for petitioners argued that the university is indulging into profiteering at the cost of colleges, who were to get such fee and charges from students at the rates prescribed by the universities. On the other hand, the colleges are incurring heavy losses for the said reason.
The petitioners have prayed that the universities be directed to refund all such fee and charges being collected by them from concerned colleges affiliated with them and be restrained from exacting such amounts from any of the affiliated colleges.
