Chandigarh: Three friends accused of kidnapping, gangraping and responsible for the death of a budding architect girl have been sentenced to 20 years rigorous imprisonment. The verdict came in the court of Additional District and Sessions Judge Anshu Shukla on Friday.
The court also slapped a fine of Rs 5.22 lakh each on all the three convicts. The accused were convicted on January 31.
On the charges of kidnapping, gangraping and causing death due to drug overdose, the court sentenced Rajat Beniwal, a Panjab University student, Kamal Singh, a dhaba owner, and Dilpreet, also a student, for gangrape, unnatural offence, criminal conspiracy causing disappearance of evidence, culpable homicide not amounting to murder and kidnapping.
The medical examination of the girl revealed gangrape and death due to drug overdose. She had gone missing after she left her home for a private institute in Sector 34.
Joginder Singh, father of the girl, with wet eyes after the verdict, said, “We have finally got justice for our daughter. The brutes have met their fate.”
According to the case file, all of them, who allegedly consumed heroine along with Manisha Singh (20), have been charged under Sections 363 (kidnapping), 365 (wrongful confinement), 304 (culpable homicide not amounting to murder), 201 (causing disappearance of evidence) and 120-B of the Indian Penal Code (IPC).
The victim and all the three youths were on an excursion. They reportedly consumed drugs after which the girl developed some complications and fell unconscious. The boys taking her dead, dumped her in a runnel.
During the investigation, the police zeroed in on Rajat Beniwal from the mobile phone data, who told the police that he, Manisha, another friend Kamal, and Dilpreet, with whom Manisha was in a relationship, were consuming heroine inside his car where Manisha died due to an overdose.
Rajat, Kamal and Dilpreet panicked when Manisha died and decided to drive the car to an isolated place where they dumped the body in a runnel, states the charge sheet.
Initially the three convicts have been framed in the charge sheet for sections of criminal conspiracy, causing disappearance of evidence, culpable homicide not amounting to murder and kidnapping, The charges of gangrape and unnatural offence were added later.
The complainant (Joginder) had also moved an application before the court to add offences of rape and unnatural offence. After getting the medical record and reports verified, the charges were added against the accused.
The CFSL, based on the report, confirmed gangrape. It said, “Human semen was detected in exhibits which were an anal swab and a vaginal swab .The board is of opinion that vaginal and unnatural sexual intercourse had taken place.”
Also on April 17 the father of the girl sought addition of Section 302 of the IPC and after CFSL submitted the report, on April 24 the court dismissed the application of inclusion of Section 302 to the existing sections.
