TYTLER REFUSED TO UNDERGO LIE DETECTOR TEST This case pertains to the murder of three Sikhs at Gurudwara Pulbangash on 1st November 1984. On the recommendation of Nanavati Commission the case was registered against Jagdish Tytler in the year 2005.On 4.12.2015, the Court rejected the 3rd clean chit given to Jagdish Tytler and gave CBI the lines on which the investigation is to be conducted. The court had stated in the order rejecting the clean chit given to Jagdish Tytler that it would monitor the investigation every two months so that no aspect of the matter is left uninvestigated.On 08.02.2017, CBI filed an application for obtaining consent from Abhishek Verma and Jagdish Tytler for conducting lie detector test.The Hon’ble Court of Shivali Verma ACMM, Karkarkadooma passed an order on 09.05.2017,asking Jagdish Tytler and Abhishek Verma to give their clear consent whether they want to undergo lie detector test or not? And in case there are any conditions attached to the consent, they are directed to appear in person before Court.Today Jagdish Tytler filed his affidavit refusing to undergo lie detector test. Thus, refusing to give consent for lie detector test an adverse inference needs to be drawn against Jagdish Tytler. Earlier Jagdish Tytler was shouting in media that he wants to undergo lie detector test and when an application was moved by CBI for obtaining consent of Jagidh Tytler, he filed an affidavit refusing to undergo lie detector test.Mr. Phoolka, stated before media that CBI should arrest Jagdish Tytler and carry out a custodial interrogation to complete the further investigation in this matter.
