Fatehgarh Sahib:The court of Judicial Magistrate, First Class, Fatehgarh Sahib, awarded six months imprisonment in a dishonor of a cheque case. Piara Singh, resident of village Mehdoodan, had filed complaint against Parminder Singh Toor, resident of Nanglan, Fatehabad, Haryana, on September 21, 2015 under Section 138 of Negotiable Instruments Act, 1881. As alleged in the complaint, in January, 2014, accused borrowed Rs 2 lakh from the complainant with an agreement to return the same within 6-7 months.
However, the accused allegedly failed to return the said amount and in order to discharge his aforementioned legal liability, accused issued a cheque of Rs 2 lakh in favour of the complainant. However, the cheque, when presented for encashment, was allegedly returned unpaid with the remarks ‘funds insufficient.’ Upon assurance of accused, complainant again presented the said cheque for encashment but the same was again dishonoured with the remarks ‘funds insufficient.’
