High Court stays transfer of PSEB employees
Chandigarh(DP Correspondent) – The Punjab and Haryana High Court on Monday stayed the transfers of the employees of the Punjab School Education Board (PSEB) till next date of hearing. The court also directed the board authorities not to give effect to the transfer order passed on September 29 whereby the employees were transferred from board’s head office at Mohali to its regional offices at Moga, Amritsar, and Patiala. Among the transferred employees are the vice presidents and general secretary of the Punjab School Education Board Employees’ Association.The court also issued notice of motion for November 2. After hearing counsels for the parties, the Bench of Justice Tejinder Singh Dhindsa passed the order on a petition filed by Parvinder Singh and others who had alleged mala fide against the chairman of the board on account of their association activities.Counsel for the petitioners Kapil Kakkar and Hema Kakkar submitted that in the order passed on September 29 transferring the petitioners from Mohali to various regional offices it has been stated that a demand has been made for more staff by the district managers of these regional offices which is factually incorrect as no such demand was made. So, the order is perverse and in fact, has been passed by the chairman with mala fide intentions just to victimise the petitioners and it is therefore was not sustainable, the counsels added.The counsel further contended that transferring the petitioners along with posts is also on account of biased attitude as to the places where they have been transferred already the employees are in excess. The Bench observed that filing of the caveat petition by the Board in a transfer matter itself shows that there was something else other than the reasons given in the order and therefore made it clear to the counsel of the board that the validity of the transfer order would be seen as per the reasons contained in the transfer order.
