Bathinda: District Consumer Forum has imposed a penalty of Rs 10 lakh on two private hospitals of the city for negligence reported in treating a patient that led to her death. According to information, the legal heirs of one Sarabjit Kaur had filed a complaint with the District Consumer Disputes Redressal Forum here against Dr Vikas Chhabra of Chhabra Hospital, Dr D K Sharma of Badyal Hospital and DMCH, Ludhiana, stating that the death of their patient occurred due to Septicemia with ARDS with Acute Tubular Necrosis (ARF). They had accused the respondents of showing negligence in performance of the duty.
The inquiry report in the case, however, suggested that no negligence appeared in the treatment of Sarabjit Kaur but medical report had not examined the aspect that Chhabra and Sharma were not in a position to control the complications arose after the operation. The complainant had claimed Rs 17.5 lakh as compensation which included Rs 5 lakh allegedly spent on treatment but as per the complainants they had paid only Rs 60,000 to Dr Chhabra and Dr Sharma and Rs 40,000 to DMCH, Ludhiana. The complainants also claimed Rs 12 lakh on account of compensation but they had not justified the amount by further elaboration.
Keeping in view the totality of the circumstances, the complainants have been held entitled to consolidated sum of Rs 10 lakh as compensation which included medical expenses and all other miscellaneous charges. The District Consumer Disputes Redressal Forum president M P S Pahwa, while issuing orders, directed Dr Chhabra and Dr Sharma to pay Rs 10 lakh as compensation to the complainants-Kattar Singh (father), Avtar Singh (brother), Baljinder Singh (brother) and Simarjit Kaur (sister). The respondents have been asked to comply with the orders within 45 days from the recipt of the copy, failing which the amount of Rs 10 lakh would carry interest @ 9 per cent per annum, reads the order.
