Chandigarh: Punjab and Haryana High Court on Tuesday directed Secretary, Punjab Local Government Department, to take final decision on a complaint of Counsellor Jagdish Raj Raja. The counsellor had filed a complaint against Mayor and Commissioner of Municipal Corporation, Jalandhar within a period of three months. Direction came from Justice Rameshwar Singh Malik.
The petitioner had said that the Mayor is not calling meetings of the General House of the Municipal Corporation regularly in accordance with provisions of Section 55 of the Punjab Municipal Corporation Act, which mandates that at least one meeting of the General House shall be convened every month, whereas the Mayor has hardly convened one meeting of the House in a year during 2012, 2103 and 2014. The Mayor does not convene the meetings even on requisition by more than one fourth of total strength of members of the House.
Thus, the members of the House are deprived of their right to participate in such meetings. The other grievance of the petitioner is that due to none convening of regular meetings of the House, the Commissioner is misusing his powers, and is using those powers also, which are within domain of the General House.
In this process, the petitioner, and other counsellors of opposition parties, is deprived of their democratic right to regularly participate in the meetings of the House and to raise their voice against wrong decisions of the Mayor and Commissioner.
The petitioner had submitted a detailed complaint to Secretary, Punjab Local Government Department also way back in 2014 seeking removal of Mayor for misusing his powers and also against the Commissioner for his illegal actions, but no action was taken.
